Terms of Service

These Terms govern your use of MindSetPlus — the website, the mobile apps, the Saathi AI companion, and the clinician dashboard (collectively, the “Service”). By creating an account or using the Service you agree to these Terms. Please read them carefully, especially the sections on safety, AI limitations, and limits of liability.
MindSetPlus is not an emergency service. If you or someone you know is in immediate danger, call your local emergency number or one of the helplines listed in our footer (Tele-MANAS 14416, Vandrevala 9999 666 555, iCall 9152 987 821, AASRA 022-2754-6669).

1. Who we are

MindSetPlus is operated by Mindset Labs Private Limited (“MindSetPlus,” “we,” “us,” or “our”), an India-based company building AI-supported emotional wellness tools. You can reach us at support@mindsetplus.ai.

2. Who can use MindSetPlus

  • You must be at least 18 years old.
  • You must provide accurate, current information when creating your account.
  • You must comply with all applicable laws in your jurisdiction.
  • If you are signing up as a mental-health professional, you must hold a valid registration / license issued by the relevant Indian council or authority, and you must keep your registration in good standing.

3. Accounts & sign-in

  • Patients and clinicians sign in using a WhatsApp-delivered one-time code (OTP). We do not store passwords for these accounts.
  • You are responsible for keeping access to your WhatsApp phone number secure. If you lose access, contact us promptly.
  • One person, one account. Do not share accounts or impersonate another person.
  • Super-admin accounts use a separate username + password mechanism and are restricted to authorised MindSetPlus staff.

4. Plans, billing & license codes

4.1 D2C subscription plans

MindSetPlus offers a free tier alongside paid subscription tiers for individual users. The specific plan names, pricing, and the features included in each tier are still being finalised and may change before launch. The current plan options, prices, and feature inclusions will always be shown in-app at the point of subscription, and that in-app information governs. Where a subscription is paid, it will auto-renew at the end of each billing cycle unless cancelled. You may cancel at any time; cancellation takes effect at the end of the then-current cycle.

4.2 B2B license codes

  • Clinicians may purchase license packs that contain a set number of single-use codes for their patients. Pack sizes and per-license pricing are not yet final and are subject to change. For current pricing, write to invest@mindsetplus.ai or support@mindsetplus.ai.
  • Each license code is single-use. The validity period of an unused or activated code is set out at the time of purchase.
  • When a patient enters a valid code, they are automatically connected to the issuing clinician and granted Pro-level feature access for the duration of the license.
  • On license expiry, the patient retains access to their personal data and Saathi history but loses the clinician dashboard connection until a new code is applied.
  • License codes are not transferable, refundable after activation, or convertible to D2C subscription credit.

4.3 Taxes & refunds

Prices are inclusive of applicable GST unless stated otherwise. Subscription fees are non-refundable except where required by law. Unused license-pack codes may be refunded within 7 days of purchase if no codes from the pack have been activated.

5. Patient use — what MindSetPlus is, and isn’t

MindSetPlus is an emotional-wellness support platform. Saathi is an AI companion designed to listen, reflect, and help you build wellness habits between sessions with a human professional.

  • Saathi does not diagnose any medical or psychological condition.
  • Saathi does not prescribe medication or any other treatment.
  • Saathi does not replace therapy, psychiatric care, or any other form of professional treatment.
  • The platform is not designed for emergencies. In an emergency, use the helplines in our footer or call your local emergency number.

6. Clinician use

  • You must complete identity and credential verification (registration number, degree, and specialty certificate) before your account can take any write action on patient data.
  • While your account is in pending approval or re-upload pending state, your account is read-only.
  • You may only access information about patients connected to you. You agree not to attempt to access, copy, or share information about anyone outside your connected caseload.
  • Doctor-authored clinical notes and assessment reviews are written under your professional responsibility and judgment. You retain professional accountability for the clinical care you provide.
  • Your personal phone number is never displayed to patients; patients see only a Doctor ID inside the Open Line chat.
  • You agree to comply with all applicable codes of professional conduct, the Indian Medical Council Act, NABH standards (where applicable), and other regulations governing your practice.

7. Institutional (B2B) use

Institutional customers purchasing licenses on behalf of clinicians acknowledge that they receive aggregated, de-identified usage data only. They do not, and shall not attempt to, receive individual patient identifiers or identifiable health data through the institutional dashboard.

8. Crisis safety

MindSetPlus operates a non-dismissible crisis-safety workflow. The workflow triggers when:

  • You or your message contain language matching the platform’s crisis keyword list,
  • Your 3-day rolling average mood score is below zero,
  • Your connected clinician manually flags you as high-risk, or
  • You express severe self-harm intent in a Saathi conversation.

When the workflow triggers, you will be asked whether you are okay or need help. If you indicate that you need help, the platform will show helpline information and notify your connected clinician. By using the Service, you agree to this safety workflow.

9. Acceptable use

You agree not to:

  • Use the Service for anything illegal, fraudulent, or harmful to others.
  • Submit content that infringes someone else’s rights, defames anyone, or contains malicious code.
  • Attempt to reverse-engineer, decompile, scrape, or otherwise interfere with the Service.
  • Attempt to access another user’s account or data, or bypass our access controls and rate limits.
  • Use the Service to deliver advertising or unsolicited messages to other users.
  • Misrepresent your identity, professional credentials, or affiliation.

10. Your content

Your mood entries, journal text, Saathi conversations, and messages to your clinician remain your content. We do not claim ownership over them. You grant MindSetPlus a limited, non-exclusive licence to host, process, encrypt, summarise, and display your content solely for the purpose of operating the Service and delivering it to you and (where you have opted in) your connected clinician.

You are responsible for the legality and accuracy of what you submit. You should not submit information about other identifiable individuals without their consent.

11. AI features

  • Saathi conversations and journal AI summaries are produced by third-party AI models under a contractual data-processing agreement.
  • AI outputs are probabilistic and may be incorrect, incomplete, or out of date. Use your judgment and consult a professional for any clinical decision.
  • We do not use your conversations, journals, or messages to train third-party AI models.

12. Service availability & changes

We aim for high availability but do not guarantee uninterrupted access. We may update, suspend, or discontinue features from time to time. Where a change materially affects you, we will give reasonable notice.

13. Suspension and termination

  • By you. You may stop using the Service or delete your account at any time. Once deleted, your personal data is removed in accordance with our Privacy Policy.
  • By us. We may suspend or terminate access if you breach these Terms, if your clinician registration lapses or is revoked, if continued service would expose you or others to harm, or if required by law.

14. Disclaimers

Except as required by law, the Service is provided “as is” and “as available.” We make no warranties about fitness for a particular purpose, merchantability, or non-infringement. Nothing on the Service constitutes medical advice, diagnosis, or treatment.

15. Limitation of liability

To the maximum extent permitted by law, Mindset Labs Private Limited and its officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or intangible losses arising out of or in connection with your use of the Service. Our aggregate liability for any direct losses arising out of or in connection with the Service is limited to the greater of (a) the amounts you paid us in the twelve months preceding the claim, or (b) ₹10,000.

Nothing in these Terms limits liability that cannot be excluded under applicable law, including liability for gross negligence, wilful misconduct, or death or personal injury caused by negligence.

16. Indemnity

You agree to indemnify Mindset Labs Private Limited against losses arising from your misuse of the Service, your breach of these Terms, your infringement of any third party’s rights, or — for clinicians — your professional care decisions.

17. Governing law & jurisdiction

These Terms are governed by the laws of India. Subject to applicable consumer protection law, the courts at Mumbai, Maharashtra shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service.

18. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified in-app or by email at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance.
